General conditions of sale
All orders a José Pintaluba y Cía., S.L. imply full acceptance and knowledge of the present general conditions of sale, which can only be modified, fully or partially, through the particular clauses of the accepted budget or through the drafting of an alternative contract between the parties.
1. COMMANDS
All orders must be made in writing, even if they have previously been established by telephone or by any other means. These must be sent to José Pintaluba y Cía., S.L. by fax or email and must contain, with the least, the following information:
(i) Fiscal identification and contact details of the Customer; (ii) Form of payment i (iii) Required services and/or no. of budget.
José Pintaluba y Cía., S.L. assumes the business risk and risk related to the contracted Services and, accordingly, all liability arising from: (i) the appropriate execution of the works necessary for the installation of the Products, (ii) the correct assembly of the same and (iii) compliance with all current regulations relating to the execution of civil works.
To this end, José Pintaluba y Cía., S.L. declares and guarantees that it has the necessary and sufficient resources to carry out the Services offered in order to carry out the requested work in accordance with the provisions of these General Conditions. In any case, the Customer authorizes, from the moment each order is issued, what José Pintaluba y Cía., S.L., when it deems it appropriate and by mutual agreement with the client, may subcontract the provision of some Services to a third party.
2. FORMS OF PAYMENT
The customers of José Pintaluba y Cía., S.L. they can choose, according to your convenience, any of the following forms:
(i) PREPAYMENT. Once the order is placed and the total amount is known, this will be paid in cash or transfer in one of the accounts that will be provided to the customer. Once the entry is made, the customer must send the bank receipt to José Pintaluba y Cía., S.L.. Upon receipt of the amount in our bank account, the order will definitely be accepted.
(ii) TRANSFER, BANK REBUTT or PAY. To be able to choose this option it is necessary that previously José Pintaluba y Cía., S.L. have authorized the credit, either directly or through a third party. This authorization requires an annual volume of operations greater than 3.000 euros from the date of the application. Receipts will be direct debited as agreed with the Customer. José Pintaluba y Cía., S.L. reserves the right to accept or deny any request for funding reasons.
(iii) If you wish to propose another form of payment, it will be necessary to contact us to expose it and that it can be studied by José Pintaluba y Cía., S.L..
3. CONDITIONERS
Delay in payment will result in the payment of interest, calculated at the bank discount rate, as well as commissions and expenses. If, before completing all or part of the order, facts or circumstances occur that cause the buyer to reasonably fear non-compliance, the delivery of the goods may be suspended if the buyer does not anticipate payment.
All goods supplied shall be the property of José Pintaluba y Cía., S.L. until full payment of the same, and may not be transferred to third parties. José Pintaluba y Cía., S.L. the "right of ownership" of the material is reserved until the debt is fully cancelled, being able to recover the materials delivered so far. Withholding of payments or compensation for potential litigious claims of the customer is not allowed.
4. DELIVERY TERMS
The delivery times indicated by José Pintaluba y Cía., S.L. they are merely indicative. Delays in delivery caused by third parties or force majeure will not be grounds for the cancellation of the order nor will they entitle the buyer to demand compensation.
If for the convenience of the customer it is necessary to postpone the delivery, must be notified in writing to José Pintaluba y Cía., S.L.. If the postponement is accepted, this will authorize the company to invoice the material requested and/or received to date.
5. CANCELLATION OF ORDERS
No returns are accepted without prior compliance of José Pintaluba y Cía., S.L.
The customer will not be able to cancel their orders if the company has complied with the agreed terms and prices.
Nor can orders be canceled in the following situations:
(i) when services have already been performed, fully or partially, o (ii) mandarin, in the case of hardware, this had already been received or requested by José Pintaluba y Cía., S.L..
6. GUARANTEES
Legal note on warranty conditions
José Pintaluba y Cía., S.L. establishes differentiated guarantees for private and professional clients, according to the applicable regulations.
6.1. Clients particulars (domestic)
Legal guarantee of consumer goods: 3 years.
Guarantee of repairs: 3 mesos.
Facilities: 1 year warranty from the end of the work.
After-sales service and availability of spare parts for a minimum of 10 years.
They are excluded from this guarantee: improper use, unauthorized modifications, inadequate maintenance, accidents, negligence or force major.
6.2. Clients professionals / industrial works
The equipment supplied is new and original. The manufacturer's warranty will be the only one applicable.
The installation has a commercial warranty of 12 months from the completion of the works, limited to execution defects.
Complaints must be submitted within the established deadlines and in writing.
For repairs in a professional environment, the guarantee is of 90 days on the intervention carried out.
7. PRIVACY
José Pintaluba y Cía., S.L. undertakes to maintain the confidentiality of the data provided by customers, which will only be used to establish direct contact. Customers have the right to access, rectification and cancellation of your data through written communication, fax or e-mail to the Administration Department.
8. JURISDICTION
The present conditions will be governed by the Spanish law. All differences that cannot be resolved amicably will be submitted to the jurisdiction of the Courts of Reus, with express waiver of any other jurisdiction.
